By accessing or using Hangaroo ("Platform," "Hangaroo," "we," "us"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the Platform.

1. Platform Purpose & Role

Hangaroo is a technology marketplace that enables independent aircraft owners, pilots, and certified flight instructors ("CFIs") to discover one another, share information, and coordinate scheduling.

Hangaroo does not:

  • Own, operate, manage, or maintain aircraft
  • Provide flight instruction or training
  • Employ or contract with CFIs or aircraft owners
  • Act as an air carrier, charter operator, flight school, or broker
  • Control or supervise flight operations
  • Determine pilot, aircraft, or instructor regulatory compliance

All aviation activities occur exclusively between users, independent of Hangaroo.

2. No Agency, Employment, or Partnership

Nothing in these Terms creates any agency, partnership, joint venture, employment, or fiduciary relationship between Hangaroo and any user.

All users act as independent third parties and are solely responsible for their own actions, decisions, and compliance with applicable laws and regulations.

3. User Roles & Responsibilities

3.1 Pilots

Pilots are solely responsible for:

  • Holding all required certificates, ratings, endorsements, and medical qualifications
  • Ensuring compliance with all applicable aviation regulations
  • Determining whether a flight is lawful and safe to conduct
  • Providing accurate and truthful documentation

3.2 Aircraft Owners

Aircraft owners are solely responsible for:

  • Determining aircraft airworthiness and legal availability
  • Verifying pilot qualifications, documents, and insurance
  • Determining whether a pilot may operate their aircraft
  • Complying with all insurance, regulatory, and operational requirements

3.3 Certified Flight Instructors (CFIs)

CFIs are solely responsible for:

  • Maintaining valid instructor certification and currency
  • Determining whether instruction may be lawfully provided
  • Conducting instruction in compliance with applicable regulations

Hangaroo does not verify, approve, or supervise any instructional activity.

4. Document Uploads & Administrative Review

4.1 Document Upload Requirement

Hangaroo may require users to upload certain documents (e.g., medical certificates, pilot certificates, insurance) as a condition of accessing platform features.

These requirements exist solely for platform participation and do not constitute verification of:

  • Regulatory compliance
  • Medical sufficiency or fitness for flight
  • Insurance adequacy
  • Flight eligibility

4.2 Administrative Review

Hangaroo may perform limited administrative review of uploaded documents to confirm:

  • Readability
  • Apparent authenticity
  • Presence of dates
  • Name consistency
  • Apparent existence of the individual in public registries

Such review is informational only and does not constitute approval, certification, or verification for flight or instruction.

4.3 Owner & CFI Responsibility

All documents are shared with relevant aircraft owners and/or CFIs. Owners and CFIs remain solely responsible for independently reviewing documents and determining whether they meet their requirements.

5. Bookings, Requests & Scheduling

All booking requests represent requests for availability and coordination only.

Hangaroo:

  • Does not approve flights
  • Does not determine eligibility to fly
  • Does not authorize aircraft use
  • Does not supervise training or operations

Any approvals or confirmations occur solely between users.

6. Payments (If Applicable)

If payment features are introduced, Hangaroo acts solely as a technology facilitator. Hangaroo is not the seller of aviation services and is not a party to any flight, rental, or instructional agreement.

Specific payment terms, if any, will be governed by supplemental agreements.

7. Assumption of Risk

Users acknowledge that aviation activities involve inherent and significant risks, including serious injury or death.

By using the Platform, users voluntarily assume all risks associated with aviation activities coordinated through Hangaroo.

8. Disclaimer of Warranties

The Platform is provided "as is" and "as available."

Hangaroo disclaims all warranties, express or implied, including but not limited to:

  • Fitness for a particular purpose
  • Merchantability
  • Accuracy or completeness of information
  • User compliance with laws or regulations

9. Limitation of Liability

To the maximum extent permitted by law, Hangaroo shall not be liable for:

  • Any flight operations
  • Any training or instruction
  • Any aircraft condition or airworthiness
  • Any user action or omission
  • Any injury, death, or property damage

In no event shall Hangaroo's liability exceed the amount paid to Hangaroo by the user in the preceding 12 months.

10. Indemnification

Users agree to indemnify, defend, and hold harmless Hangaroo from any claims, damages, losses, liabilities, or expenses arising from:

  • Flight operations
  • Aircraft use
  • Instruction or training
  • Regulatory violations
  • User misrepresentations

11. Arbitration & Governing Law

Any dispute arising from these Terms shall be resolved by binding arbitration, except where prohibited by law.

These Terms shall be governed by the laws of the State of Tennessee (Chattanooga), without regard to conflict-of-law principles.

12. Modifications

Hangaroo may update these Terms from time to time. Continued use of the Platform constitutes acceptance of the updated Terms.
